Rules for purchasing goods

  • TERMS AND CONDITIONS FOR CONDUCTING COMMERCIAL GOODS ACTIVITIES

    1. GENERAL PROVISIONS
    1.1. These rules for the purchase and sale of goods (hereinafter referred to as the "Rules") are a legally binding document for the Parties, establishing the rights, duties, and responsibilities of the Buyer in acquiring goods for commercial activities through this online store.
    1.2. The Seller reserves the right to change, amend, or supplement the rules at any time, taking into account the requirements set forth in legal acts. The Buyer is informed about any changes on the online store's website. The Rules applicable at the time of placing the order apply to the Buyer when shopping in the online store.

    1.3. The following have the right to purchase in the online store:
    1.3.1. active legal individuals, i.e., individuals who have reached the age of majority, whose legal capacity is not restricted by a court order, acquiring goods or services for commercial activities;
    1.3.2. minors aged 14 to 18, only with the consent of parents or guardians, except in cases where they independently dispose of their income when acquiring goods or services for commercial activities;
    1.3.3. legal entities acquiring goods or services for commercial activities;
    1.3.4. authorized representatives of all the above-mentioned persons.
    1.4. By confirming the rules, the Seller also guarantees that, according to point 1.3 of the rules, the Buyer has the right to purchase goods in the online store.
    1.5. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer, having formed the shopping cart in the online store, indicated the delivery address, selected the payment method, and familiarized themselves with the Seller's rules, clicks the "Confirm Order" button (see point 5 "Ordering Goods, Prices, Payment Procedure, Terms").
    1.6. Each contract concluded between the Buyer and the Seller is stored in the online store.

    2. PERSONAL DATA PROTECTION
    2.1. The Buyer can order goods in the online store by:
    2.1.1. Registering in this online store - entering the required data during registration;
    2.1.2. Ordering without registering in this online store.
    2.2. When ordering goods in the ways specified in point 2.1, the Buyer must provide the necessary personal data for the proper execution of the order in the respective information fields provided by the Seller: name, surname, delivery address for the goods, phone number, and email address.
    2.3. By confirming these rules, the Buyer agrees that the personal data provided in point 2.2 will be processed for the sale of goods and services in the online store, for the analysis of the Seller's activities, and for direct marketing purposes.
    2.4. Agreeing that the Buyer's personal data will be processed for the purpose of selling goods and services in the Seller's online store, the Buyer also agrees that informational messages necessary for the fulfilment of the order will be sent to the email address and phone number provided by the Buyer.
    2.5. The Buyer, by registering in the online store and ordering goods, undertakes to keep and not disclose the login information to anyone.

    3. BUYER'S RIGHTS AND OBLIGATIONS
    3.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules and the procedures specified in other sections of the online store information.
    3.2. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
    3.3. If the data provided in the Buyer's registration form changes, the Buyer must promptly update them.
    3.4. The Buyer undertakes not to transfer their login information to third parties. If the Buyer loses their login information, they must immediately inform the Seller using the contact details specified in the "Contacts" section.
    3.5. By using the online store, the Buyer agrees to these purchase and sale Rules and undertakes to comply with them and not violate the laws of the Republic of Lithuania.
    3.6. The Buyer undertakes to inspect the quality of the received goods within 48 hours. Otherwise, the Seller does not accept any claims.

    4. SELLER'S RIGHTS AND OBLIGATIONS
    4.1. The Seller undertakes to provide all conditions for the Buyer to properly use the services provided by the online store.
    4.2. If the Buyer attempts to harm the stability and security of the Seller's online store or violates their obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer's ability to use the online store or, in exceptional cases, cancel the Buyer's registration.
    4.3. The Seller undertakes to respect the Buyer's privacy rights regarding the Buyer's personal information provided in the online store registration form.
    4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.

    5. ORDERING GOODS, PRICES, PAYMENT PROCEDURE, TERMS
    5.1. In the online store, the Buyer can purchase goods 24 hours a day, 7 days a week.
    5.2. The contract comes into effect when the Buyer clicks the "Confirm Order" button, and upon receiving the order, the Seller confirms it by sending a confirmation email to the Buyer's specified email address.
    5.3. The prices of goods in the online store and in the order placed are indicated in euros.
    5.4. The Buyer pays for the goods using one of the following methods:
    5.4.1. Payment using online banking – this is a prepayment made using the Buyer's chosen online banking system.
    5.4.2. Payment by bank transfer – this is a prepayment where the Buyer, after printing the order and going to the nearest bank branch, transfers the money to the online store's bank account.
    5.4.3. Cash payment to the courier upon delivery of the goods.
    5.5. The Buyer undertakes to pay for the goods immediately. If the order is paid later, the Seller cannot guarantee that the stock of goods will not change. This provision does not apply to cash payments to the courier upon delivery. Order processing (reservation of goods in the warehouse and organization of delivery) begins only after receiving payment for the goods. The delivery time starts to be calculated on the next business day from the moment of payment for the goods.

    6. DELIVERY OF GOODS
    6.1. The Buyer undertakes to provide an accurate delivery address with the postal code and a contact phone number for the delivery of goods. Ensure that the specified delivery address is easily accessible by the carrier. If the order cannot be delivered to the specified address, redirection or additional delivery will incur additional costs. Before delivering the order, the carrier contacts the recipient at the phone number specified in the order. Make sure that the specified phone number is turned on and reachable for contact.
    6.2. The Buyer undertakes to accept the goods personally. In the event that the Buyer cannot personally accept the goods, and the goods are delivered to the specified address, the Buyer has no right to make claims to the Seller regarding the improper delivery of goods to the wrong recipient. Be understanding and do not entrust/leave incapable persons, children, or elderly individuals to accept the goods. The weight of the delivered goods may be too heavy for them to move the goods to another location, shift them, etc.
    6.3. The goods are delivered to the Buyer:
    6.3.1. If the weight of the goods is up to 30 kg, the goods are delivered within 4-5 business days from the confirmation of full payment. The goods are delivered either by postal services (Omniva, LP Express) or courier services (OMNIVA, LP Express, Venipak, DPD). The delivery method is determined by the Seller, unless the Buyer indicates otherwise in the comments. Goods are delivered only on business days from 08:00 to 17:00. The goods are not delivered on Saturdays, Sundays, and public holidays.
    6.3.2. If the weight of the goods exceeds 30 kg, the goods are delivered within 6-8 business days from the confirmation of full payment. The goods are delivered by Itella Logistics, Raben Lietuva, or PEAKES carriers. Goods are delivered only on business days from 08:00 to 17:00. The goods are not delivered on Saturdays, Sundays, and public holidays.
    6.4. The shipping cost for an order totalling less than 49 EUR (excluding VAT) is 2.95 EUR throughout Lithuania (when using parcel lockers). When choosing courier delivery services (DPD, Venipak, Omniva, LP Express), the cost is calculated individually by entering the delivery address specified by the Buyer, except for delivery to Neringa + 40.00 EUR. Cash payment to the courier upon delivery incurs an additional fee. The cost of this service is calculated individually by entering the delivery address specified by the Buyer.
    6.5. For orders totalling over 49 EUR, delivery is organized for free. An additional fee of 40 EUR is applied for delivering an order to Neringa.
    6.6. In all cases, the Seller is exempt from responsibility for failure to meet the delivery terms if the goods are not delivered or are not delivered on time due to the Buyer's fault or circumstances beyond the Seller's control (e.g., if the Buyer incorrectly provided the phone number or delivery address during order placement).
    6.7. When receiving a shipment, please carefully inspect the shipment package. If it is damaged, mark "PACKAGE DAMAGED" on the carrier's delivery receipt; otherwise, you agree that you received an undamaged package. If you receive an undamaged shipment but find a discrepancy in the goods (received a different product, colour/quantity/kit does not match), inform us immediately, within 2 business days of receiving the goods. In this case, we will rectify inaccuracies free of charge. The Seller does not accept claims reported later than 2 business days after receiving the goods.
    6.8. The Buyer must send photos of the damaged shipment and/or product(s) to the Seller by email.
    6.9. For goods over 30 kg, unloading is the responsibility of the Buyer. According to the international carriers' convention, the Buyer cannot demand that the carrier carry goods weighing more than 30 kg into the house or workplace.
    6.10. If the Buyer receives a damaged product during transportation, the Buyer must file claims only with the transport company that transported the product. The Seller is not responsible for goods damaged during transportation.
    6.11. Assembly of goods. Please note that starting from 2017, when assembling cosmetic and salon furniture, you need to have your own screwdriver set. Specific screwdrivers/wrenches are included, but the Buyer must have standard screwdrivers.

    7. QUALITY OF GOODS, WARRANTIES
    7.1. All products sold in this online store are intended for professional use in commercial activities.
    7.2. We guarantee the trouble-free operation of the devices for 12 months (unless a shorter period is indicated in the product description) from the date of sale. During this period, we will eliminate any defects that occur in the product at no additional cost. The warranty period remains unchanged after warranty repair and is not extended.
    7.3. The product is accepted for warranty repair only with purchase documents, in clean, original packaging, with all accompanying elements. Otherwise, the buyer bears the cost of delivering missing parts for warranty repair.
    7.4. The data of each product sold in the online store are generally specified in the description of each product.
    7.5. The seller is not responsible if the products in the online store, in terms of colour, shape, or other parameters, do not correspond to the real size, shapes, and colours due to the buyer's display characteristics.
    7.6. The seller provides a specific period of validity for the quality guarantee for certain types of products, and the specific terms and conditions are indicated in the descriptions of such products.
    7.7. In cases where the seller does not provide a quality guarantee for certain types of products, the warranty specified by relevant legislation applies.
    7.8. The buyer arranges the transport for warranty repair.
    7.9. The buyer bears the costs of delivering goods for warranty repair, retrieving goods from warranty repair, exchanging goods, or returning them.
    7.10. Warranty repair of cosmetic beds/tables is carried out at the service centres of these beds/tables' manufacturer (Poland, Italy). Transportation costs to/from warranty repair are not compensated. The buyer takes care of this.

    8. WARRANTY REPAIR

    8.1 Warranty repair does not apply:
    8.1.1. if the malfunction occurred due to non-compliance with instructions or improper use;
    8.1.2. if the product casing is damaged;
    8.1.3. if the seals of the product connections are damaged;
    8.1.4. due to significant voltage fluctuations in the electrical network;
    8.1.5. due to arbitrary repair, modifications, or construction changes;
    8.1.6. for plastic casings, tips, and finishing details, axles, belts, connecting and power cables, leather and leather substitutes for staining with other clothes or items;
    8.1.7. for belts, intermediates, treadmills, bearings, hoses, faucet shower, water mixer, and other details with limited service life;
    8.1.8. if the electrical part of the device was wetted or spilled with water or other liquids;
    8.1.9. the device was kept at a low (negative) temperature;
    8.1.10. if other accessories (not included in the package, non-original) were used.
    8.2. Goods for warranty repair are delivered and picked up by the seller at a previously agreed address in Lithuania.
    8.3. The buyer or his authorized person physically presents the product for warranty repair and picks it up only with their own funds.
    8.4. The seller eliminates defects in the product through warranty repair. A used product with a defect is only repaired. Such a product is not returned. Only repairable.
    8.5. Hydraulic systems of chairs and beds/tables are subject to a warranty of up to 6 months.
    8.6. Manicure and pedicure UV/LED lamps have a 3-month warranty.
    8.7. Nail drills have a one-year warranty. EXO manufacturer's drills have a 3-month warranty.
    8.8. Cosmetology devices have a 12-month warranty.
    8.9. Barber shop plumbing has a 3-month warranty from the date of delivery.

    9. RETURN AND EXCHANGE OF GOODS

    9.1. Sold goods or services on the online store www.salonams.eu are not returnable. If the buyer is dissatisfied with the purchased product, the seller may consider exchanging it only if the buyer submits a written request by email to labas@salonams.eu.
    9.2. Ordered goods are not returnable.
    9.3. The buyer can return goods not due to defects or deficiencies only if the seller allows it, confirming this fact by email.
    9.4. When returning goods not due to defects or deficiencies, the buyer is refunded only for the goods, deducting a 20% (twenty percent) administrative fee for order processing and transportation costs for returning these goods to the supplier.
    9.4.1. When returning goods, the buyer must follow these conditions: Send the completed free-form request by email to labas@salonams.eu. And only then, when you receive a written response from the seller, you can send the returned/exchanged goods to the seller's specified address.

    Note that returned or exchanged goods must meet the following requirements:
    The returned product must be in the original manufacturer's packaging, with all manufacturer's labels.
    The returned product must not have lost its commercial appearance (unworn or otherwise used, undamaged, and not devalued). ASSEMBLED GOODS CANNOT BE RETURNED. The product must not be dirty, stained, or damaged. We do not accept such goods, and we do not refund money, so when sending goods back, make sure that the returned product meets all return requirements. Goods returned from Lithuania must reach us within exactly 14 calendar days from the date of delivery of the goods to the customer; otherwise, we do not accept the goods back, and we do not refund money. Money for shipping costs is not refunded (money is refunded only for goods). The customer undertakes: The customer returning/exchanging goods must indicate the sender's address on the returned shipment and ensure that the returned goods reach the seller at the address specified by the seller for the performance of activities.
    Money is not refunded for returned goods by mail.
    Money is not refunded for returned goods to collection points in third countries.
    Money is not refunded for returned goods to Lithuanian post offices (note that the Lithuanian post does not deliver parcels to our office but leaves them in branches until claimed).

    THE SELLER UNDERTAKES
    The seller is not responsible for shipments sent to the wrong address specified by the customer. The seller undertakes, after receiving the goods returned by the buyer and inspecting their condition, to refund the money to the account from which the payment for the goods was made within 30 working days.
    Money is refunded only to bank accounts.

    9.5 NON-RETURNABLE GOODS:
    9.5.1 Lighting products are not returnable;
    9.5.2 Goods needed to receive hygiene services are not returnable (i.e., hot air sterilizers);
    9.5.3 Cosmetology devices, combiners, beauty salon furniture and equipment, barber shop furniture, and equipment are not returnable.
    9.5.4 Disinfectants and cosmetics are not returnable.
    BE CAREFUL WHEN CHOOSING THESE GOODS.

    9.6. REFUND PROCEDURE
    9.7. Money for goods is refunded only to the Customer's account from which the payment for the goods was made.
    9.8. Money is not refunded if it is noticed that the goods were intentionally damaged or damaged due to careless handling (affected by high temperature, damaged by sharp objects, etc.).
    9.9. The Seller has the right not to accept the returned goods if the Buyer does not adhere to the return procedure specified in Article 8.3.
    9.10. When returning the wrong or defective goods received, the Seller undertakes to take back such goods and replace them with appropriate suitable items.
    9.11. In case the Seller does not have suitable replacement goods, the paid amount is refunded to the Buyer, excluding the delivery cost.


    10. BUYER AND SELLER LIABILITY
    10.1. The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data on the registration form, the Seller is not responsible for the resulting consequences and has the right to demand compensation for direct losses incurred by the Buyer.
    10.2. The Buyer is responsible for actions performed using this online store.
    10.3. The registered Buyer is responsible for the transfer of their login data to third parties. If a third party uses the services provided by the online store, logging in using the Buyer's login information, the Seller considers this person as the Buyer.
    10.4. The Seller is relieved of any liability in cases where losses arise because the Buyer, disregarding the Seller's recommendations and the Buyer's obligations, did not familiarize themselves with these Rules, even though such an opportunity was provided to them.
    10.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations, or individuals, the Seller is not responsible for the information or activities on those websites, does not supervise or control them, and does not represent those companies and individuals.
    10.6. In case of damage, the guilty party compensates the other party for direct losses.

    11. MARKETING AND INFORMATION
    11.1. The Seller may initiate various promotions in the online store at their discretion.
    11.2. The Seller has the right to unilaterally change the conditions of promotions, as well as to cancel them without separate notice. Any changes or cancellations of promotion conditions apply only forward, i.e., from the moment of their implementation.
    11.3. The Seller sends all notifications to the Buyer using the contact details specified in the Buyer's registration form.
    11.4. The Buyer sends all messages and questions to the Seller's online store section "Contacts" using the telephone numbers and email addresses specified.

    12. FINAL PROVISIONS
    12.1. These rules for the purchase and sale of goods are drawn up in accordance with the laws and regulations of the Republic of Lithuania.
    12.2. All disputes arising from the implementation of these Rules are resolved through negotiations. In case of failure to reach an agreement, disputes are resolved in accordance with the laws of the Republic of Lithuania.
